AVIS Rent a Car Membership Program Terms and Conditions

These Terms and Conditions apply to customers who have enrolled in the AVIS Rent a Car Membership Program (the "Program") operated by IDEX Auto Japan Co., Ltd. (the "Company").

Article 1 (Definitions)

The following terms shall have the meanings set forth below:

  1. "Member" means an individual customer who has agreed to these Terms and Conditions, applied for membership, and whose application has been approved by the Company.
  2. "Rental Car Store" means a rental car store operated by the Company or by a franchisee that has entered into a rental car franchise agreement with the Company, and which is designated by the Company.

Article 2 (Program Benefits)

The Program is a system under which the Company and Rental Car Stores provide Members with discounts on rental fees based on the Member's usage history, as well as other benefits (the "Benefits") when the Member uses rental cars at Rental Car Stores.

The details of the Benefits shall be separately presented by the Company. The contents of the Benefits are subject to change without prior notice.

Article 3 (Membership Eligibility)

Membership is limited to individual customers (corporations and other organizations are not eligible to join).

Even if the applicant is an individual customer, membership shall not be granted, and membership shall be revoked if the Member falls under any of the following:

  1. The person does not possess a valid driver's license or is otherwise ineligible to rent a vehicle under the Company's prescribed Rental Car Rental Agreement Terms and Conditions.
  2. The person has violated or previously violated these Terms and Conditions, the Rental Car Rental Agreement Terms and Conditions, or any other agreement with the Company or a Rental Car Store.
  3. The person does not meet other criteria established by the Company.

Article 4 (Application for Membership)

A person who wishes to join the Program shall agree to these Terms and Conditions and apply for membership in accordance with the method prescribed by the Company.

Article 5 (Completion of Membership)

Enrollment in the Program shall be completed when the Company approves the application set forth in the preceding Article.

Article 6 (Acknowledgments)

Members acknowledge and agree to the following:

  1. When a Member uses Benefits, makes inquiries to the Company or a Rental Car Store, or completes any procedures related to rental cars or membership (collectively, the "Procedures"), the Company or the Rental Car Store shall verify the Member's identity in accordance with the procedures prescribed by the Company.

When a Member completes Procedures via the Company's designated website, identity verification shall be deemed complete upon entry of the email address and ID/password registered in advance by the Member. Even if a third party performs Procedures by entering such email address and ID/password, the Company shall bear no responsibility for any damages incurred by the Member associated with that email address, etc.

  1. Notices regarding Benefits and other communications to Members shall be made by posting on the official AVIS Rent a Car website, by mailing to the address registered with the Company, by sending to the email address registered with the Company, or by any other method deemed appropriate by the Company.
  1. Benefits may be used only by the Member personally. Benefits may not be lent, transferred, pledged, or otherwise provided to any third party.

Article 7 (Changes to Address, etc.)

  1. If there is any change to the address, email address, or other information registered with the Company, the Member shall promptly notify the Company in accordance with the procedures prescribed by the Company.
  2. The Company and Rental Car Stores shall bear no responsibility for any damages incurred due to the Member's failure to promptly submit such notification.

Article 8 (Withdrawal and Revocation of Membership)

  1. A Member may withdraw from the Program at any time by notifying the Company in accordance with the procedures prescribed by the Company.
  2. If a Member submits false information to the Company, improperly uses Benefits, violates these Terms and Conditions, or if the Company otherwise determines the Member to be inappropriate, the Company may revoke the Member's membership.

Article 9 (Exclusion of Anti-Social Forces)

  1. The Company and the Member represent and warrant, both presently and in the future, that they do not fall under any of the following:

    1. Organized crime groups, members of organized crime groups, persons who have not passed five years since ceasing to be members of organized crime groups, associate members of organized crime groups, companies affiliated with organized crime groups, corporate racketeers, groups advocating social movements for improper purposes, special intelligence violent groups, or any equivalent persons (collectively, "Organized Crime Group Members, etc.").

    2. Persons who have relationships in which Organized Crime Group Members, etc. are deemed to control management or be substantially involved in management, or other relationships that are socially condemnable.

    3. Persons deemed to improperly use Organized Crime Group Members, etc. for unlawful gain for themselves or third parties, or to cause harm to third parties.

    4. Persons deemed to be involved in providing funds or other benefits to Organized Crime Group Members, etc.

    5. Persons who have committed crimes involving proceeds of crime as defined under the Act on Prevention of Transfer of Criminal Proceeds (hereinafter simply "Crimes").

  2. The Company and the Member further covenant that they will not engage in any of the following acts, either by themselves or through a third party:

    1. Violent acts or unjust demands exceeding legal responsibility.

    2. Threatening behavior, use of violence, spreading rumors, fraudulent means, or use of force to damage the credibility of the other party or obstruct the other party's business.

    3. Acts constituting a Crime.

    4. Any acts equivalent to the foregoing.

  3. If a Member violates the preceding two paragraphs, such violation shall constitute grounds under Article 8, Paragraph 2, and the Company and Rental Car Stores shall bear no responsibility for any damages incurred by the Member as a result.

Article 10 (Amendment and Termination of the Program)

The Company may amend or terminate the Program by notifying Members in accordance with the method prescribed in Article 6(2).

Article 11 (Handling of Benefits upon Withdrawal, Revocation, or Termination)

If a Member withdraws, has membership revoked, or if the Program is terminated, no Benefits shall be provided after such withdrawal, revocation, or termination.

Article 12 (Amendment of These Terms)

The Company may amend these Terms and Conditions if it deems necessary. In such case, the effective date and details of the amended Terms shall be announced or notified in accordance with the method prescribed in Article 6(2).

Article 13 (Use of Personal Information)

  1. The Company shall handle personal information of Members (including drivers; the same shall apply hereinafter), such as name, date of birth, gender, address, telephone number, and email address, received in connection with applications for membership, reservations, applications, or conclusion of rental agreements, in accordance with applicable laws and the Privacy Policy published on the Company's website (https://www.idex.co.jp/privacy/index.html).
  2. Members shall review the Privacy Policy set forth in the preceding paragraph prior to applying for membership and shall apply only after agreeing to its contents.
  3. In addition to the matters set forth in the Privacy Policy in Paragraph 1 of this Article, the Company shall jointly use the following information with franchisees that have entered into rental car franchise agreements with the Company, within the scope set forth below.

【Information Subject to Joint Use】

①Personal information of Members such as name, date of birth, gender, address, and telephone number.

②Information related to reservation, application, or rental under rental agreements (date of use, vehicle type, purpose of use, rental date and time, etc.).

【Purpose of Use】

For sales communications regarding services provided by the Company or franchisees that have entered into rental car franchise agreements with the Company, for the conclusion of rental agreements, facilitation of such agreements, and development and maintenance of the franchise system structure.

Article 14 (Severability)

If any provision of these Terms and Conditions is determined to be invalid in whole or in part, the remaining provisions shall continue in full force and effect.

Article 15 (Governing Law and Jurisdiction)

  1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
  2. Any disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the location of the Company's head office as the court of first instance.

Supplementary Provision

These Terms and Conditions shall come into effect on April 1, 2026.
